on sales of goods, works and services by remote
and direct sales method from 22.01.2025
Privacy Policy
This Privacy Policy (hereinafter referred to as the Privacy Policy) is a public Contract concluded between LLP "Stella Kazakhstan" and the Buyer in accordance with Art.387 of the Civil Code of the Republic of Kazakhstan, based on the Law of the Republic of Kazakhstan "On Personal Data and Their Protection", it applies to the information containing personal data of Buyers that LLP "Stella Kazakhstan" may receive about the Buyers during the purchase of goods and services at Trading Points/Stores and/or the "ZhannaKanGroup" Online Store.
1. Definition of Terms
1.1. Non-personal data - information that is automatically transmitted when viewing advertising blocks by the Buyer and when visiting pages with a statistical script system installed: the requested page address, cookie information, IP address, browser information, referrer (previous page address), access time.
1.2. Collection of personal data - actions aimed at obtaining personal data.
1.3. Protection of personal data is a complex of measures, legal, organizational, and technical, carried out for the purposes established by the RoK Law "On Personal Data and Their Protection".
1.4. Services - services of the Seller, the Seller's partners available for use on the site https://zhannakagroup.com.
1.5. Buyer - user of the Trading point/Store, Online store.
1.6. Seller - LLP "Stella Kazakhstan" (owner of the "ZhannaKanGroup" online store).
Cookies are small text files that the browser writes data from visited sites into. Cookies perform a number of functions, for example, allowing the Buyer to move efficiently between pages, remembering his preferences, and thus improving the interaction experience, and they can also help make advertising seen by the Buyer online better match his interests. Without cookies, it will be impossible to purchase goods in the online store, as the entire cart operation is based on saving data from these files. For instance, if the Buyer selects an item in the online store, puts it in the cart, and moves to a new page, that item will not be saved in the cart.
1.8. IP address - a unique network address of a node in a computer network built on an IP protocol that allows determining the location of the Buyer. The online store does not track the location in more detail than the city and the area.
1.9. Biometric data - personal data characterizing the physiological and biological characteristics of the subject of personal data, based on which it is possible to determine his identity;
1.10. Destruction of personal data - actions that result in the impossibility of restoring personal data;
1.11. Anonymization of personal data - actions that result in the impossibility of determining the belonging of personal data to the subject of personal data.
2. Subject of the Privacy Policy
2.1. The Privacy Policy establishes the obligations of the Seller for the non-disclosure and protection mode provision of the confidentiality of personal data, which the Buyer provides at the request of the Seller when registering on the Online Store website and/or when placing an order for the purchase of goods, including at Trading Points/Stores.
2.2. Personal data permitted for processing is provided by the Buyer by filling in the registration form on the Online Store website and by performing actions confirming the intention to conduct a purchase and sale transaction through the Online Store/Sales Point manager.
2.3. Any other personal information (purchase history, used browsers, and operating systems, etc.) is also subject to reliable storage and non-distribution, except in cases provided for in clause 5.3. and clause 5.4. of the Privacy Policy.
3. Purposes of collecting and processing Buyers' personal data
3.1. The Seller collects, accumulates, supplements, processes, and stores only the personal data necessary to provide the Services and/or purchase the Buyer’s Goods from the Online Store catalog and/or at the Trading Point, as well as providing other related services by the Seller's partners (providing loans/installments for the purchase of Goods, insurance services, etc.).
The Seller uses the Buyer's personal data for the purposes indicated in the Public Contract.
4. Rights and obligations of the parties
4.1. Buyer is obliged to:
4.1.1. provide full and accurate information about personal data necessary for using the Online Store and making a purchase and sale transaction;
4.1.2. change, supplement the provided information in case of detecting incorrect data when using the Online Store.
4.2. Buyer has the right to:
4.2.1. access and edit personal data information at any time through the web interface provided within the scope of the services;
3.2.2. fully or partially withdraw the previously given consent to the use, storage, and processing of personal data if it does not contradict the laws of the Republic of Kazakhstan, or if there are outstanding obligations.
4.3. Seller is obliged to:
4.3.1. use the received information solely for the purposes specified in the Public Contract and section 3 of the Privacy Policy;
4.3.2. ensure the storage of confidential information in secrecy, not to disclose without prior written permission of the Buyer, the transferred personal data, except for data transfer for order fulfillment (courier services, postal service organizations, etc.), cooperation with the Seller's counterparties within the framework of concluded contracts (banks in the sale of Goods to Buyers on credit or installments, etc.), as well as to authorized government bodies in the manner established by the legislation of the RoK;
4.3.3. take precautions to protect the confidentiality of the Buyer's personal data according to the procedure generally used for protecting such information.
4.4. Seller has the right to:
4.4.1. provide access for data collection and analysis of Buyers to third parties for the purposes of statistics and optimization of advertising messages;
4.4.2. transfer Buyers' personal data to third parties (as defined in the Public Contract) providing services related to the sale of Goods (courier services, postal communication organizations, banks when selling Goods to Buyers on credit or installment, etc.) and for other purposes specified in the Public Contract.
5. Other conditions
5.1. The Buyer's use of the Online Store and the execution of a purchase and sale transaction implies his consent to this Privacy Policy and the conditions for processing the Buyer's personal data, as well as consent to the use of personal data in the case of purchasing Goods on credit or installment at Trading Points or for cash.
5.2. In case of disagreement with the terms of the Privacy Policy, the Buyer must stop using the Online Store or notify the Seller in writing of refusal to provide personal data after their provision.
5.3. The Privacy Policy applies to the activities of LLP "Stella Kazakhstan" and its Partners, whose services the Buyer receives.
5.4. Due to the specificity of the method of obtaining information, the Seller does not verify the accuracy of the personal data provided by the Buyer and does not control its relevance. However, the seller proceeds from the fact that the Buyer provides accurate personal data and maintains this data in an up-to-date state. The entire responsibility, as well as possible consequences for providing inaccurate or non-current personal data, rests with the Buyer.
5.5. Disabling Cookies may result in the inability to access parts of the Online Store website that require authorization.
5.6. The Online Store collects statistics on the IP addresses of its Buyers. This information is used to identify and solve technical problems and to control the legality of payments made.
5.7. The current legislation of the Republic of Kazakhstan applies to the Privacy Policy and the relationship between the Buyer and the Seller.
5.8. The Seller reserves the right to unilaterally amend this Privacy Policy to further improve the security system in accordance with the legislation of the RoK.
